Part 2 – Technology/Management Suggestions for 2012 Resolutions #4 and #5

On  January 3rd I suggested you 1) validate your backups, 2) unsubscribe from marginal sources of list serv email to reduce clutter and wasted time and 3) take steps to organize and implement your key management reports – hopefully produced from and as a by-product of your every day activity of working in your practice management software.    It’s now Feb 3rd, how did you do?

Next - for suggestion #4 why not create a top ten wishlist for areas that your practice support system should help you do more efficiently and effectively.   Once you have your wishlist, contact us or whomever you rely on for tips and strategies that can help.  Sometimes the solution is simple.  You don’t know what you don’t know so you need to ask.  You may well  be pleasantly surprised at proven solutions that are available.

For suggestion #5 – consider re-visiting your internal processes and related  procedures with an eye toward how your practice management software may be employed to streamline the process.  Start with the 20% of your common procedures that likely affect 80% of your clients-from ‘Intake to Final Invoice’.  Make an outline of your core process.  Contact Premier for our 50-60 page proforma office and system procedures guide including step-by-step instruction for Time Matters users.      Well documented procedures and a system to support them, may be the missing link to your firms improved productivity.

Update from Legal Tech New York City Jan. 31st 2012

What did I find new/interesting at LegalTech?  Here are a few selected items:

1. Lexis will have some useful new features in Time Matters version 12, and even sooner in an upcoming service release.  Look for a service release soon to support Exchange 2010 and look for some new features to be revealed soon…

2. HotDocs offers ‘Document Services’ which essentially means they can
‘ Host  Templates On-line’.  Think client intake and interviews for selected document templates.  It is both interesting and affordable.

3. Accellion – host your own file sharing and collaboration workspaces.  Secure from end to end. Hosted at your firm or on-line.  You can set yourself up for secure file transfer and rectify your ‘drop box’ problem.

4. New Practice management Software:
LiquidPractice TM  – a not yet released practice management system developed within Office365.  Since Microsofts Office 365 has Outloo Calendar, Contacts, and Email, plus Exchange 2010 and Sharepoint, then what may fill the gap for legal practice management is a matter management module and billing module.  It appears that Liquid Practice is on their way to doing exactly that and given the involvement of some of the original ProLaw develpers, it will probably happen.  Not ready for prime time yet but worth monitoring in the future.

LawLoop – a document management oriented program with plans for billing and other modules.  Interesting if you are a litigation law firm with a need to organize, annotate and manage large volumes of documents.   Their software is on-line and offers a truly new and unique approach to a well established set of document management problems.

5. I learned Equitrac, the re-imbursable cost recovery specialist, is now owned by Nuance.   Interesting – just not sure why :~)

Worldox has a new version announced at the conference.  More web based integration.

Promedia, a video  conferencing – had some LifeSize.com technology on display.  It was easy to speak with a representative in Austin, TX using the high definition video conferencing technology from Lifesize.com, a Logitech subsidiary.    HD is here and it is affordable.  I believe  use of live video will become pervasive in law firms using many types of software, for example Skype, Lifesize, GotoMeeting and Miscrsoft;s Office 365 Lync On-line.

Useful, System Related New Year Resolutions (NYR) #1, #2 and #3

NYR #1 – Safety
You should check your backup.  If you have a SQL database be sure the .bak file is being created.  Can you find it? Is it also backed up off-site?  Might be a good time to run a backup fire drill.  ’What’s everyones job, is no one’sjob’, is one person responsible for managing backups?

NYR #2  Time Management
Take the time to unsubscribe from sources of recurring email that is marginally worthwhile.  This can eliminate future time wasted with organizing or deleting unnecessary email.

NYR #3  Managing for Profits
‘You can not manage, what you don’t measure’  So, start the new year well by resolving to capture the essential data you need for sound management of your practice.  Estates and Elder Law firms need to track Calls to Consults, Consults to Retainers, and Seminar Results.   You also need follow-up reports to manage your new contacts’ Initial Call, Initial Consult, and any Seminar attended. Do you have the structure in place to do this effectively?  Also, now is a good time to track the changing mix of new matter types and their sources of origination.  Systems and procedures set in place now will help assure your 2012 is better than 2011.

Sony ‘Internet’ TV and Convergence of Technology

Picture this (pun intended),  a TV, PC and Wifi all in one package.  The holidays brought us a new TV and now, at the bottom of the TV’s menu bar, we can click to watch cable, You Tube, Amazon, Netflicks or browse the internet using Google’s Chrome browser.  We wanted to watch a movie someone recommended and couldn’t remember the name, so click1 Google search word A + B, and, tada, we quickly identified the name of movie.     Click2 was on Netflicks, not there, click 3 was on Amazon found it, click again to rent it (or buy).  Started the movie.  Very convenient, very cool.  Incidentally, the movie was ‘Leap Year’ which is a great little family movie with great scenary from Ireland – we visit in April.

The next step: I’d like to know of anyone is using new flat screen TV’s connected to your PC with Skype or something similar to enable conferencing with clients or remote meeting with staff.   Anyone…?

Scanning Tip: Time Matters Using the Fujitsu Desktop Scanner

Save steps and simplify the scanning process. The following tip helps you skip the extra steps if you are now saving the new scanned file to a folder first, before saving into Time Matters.

When using a Fujitsu desktop scanner and Time Matters software be sure to adjust the Scan Button settings to go directly to an on-screen pdf using Adobe Reader. Then simply use the TM Save button to save your new scanned file.

In ScanSnap Organizer
Go to Tools
Then ScanButton Settings
Then set the Application tab to Adobe Reader

Viewing the scan to PDF using Adobe Reader, use TMSave and the associated auto folder and file naming feature.  Time Matters can be set to automatically create your folder and file name based on pre-configured settings in Time Matters.

Back to the Future – Recording Time in Time Matters, with Basic Billing (free) or Advanced Billing System

Recently several estate type firms were asking me about time keeping systems, and both firms already owned what they required to achieve what they wanted to do.
Note: Most lawyer/law office timekeeping functional requirements are…. timeless.  I learned much of what I know about legal time billing requirements a long long time ago when I had 100 law firm billing system clients, these firms  averaged about 75 attorneys each.

Many estates practice law firm have rather basic requirements for capturing time and for producing an occasional itemized bill.   Whether you need basic or advanced billing the best practice is to eliminate duplication of data entry. This is achieved by using a program such as  Time Matters to create billable client time and expense records from other records such as event, todo, note, email, document, phone records which already have what you need i.e. the  date, timekeeper, matter reference, code, description and duration.  Time Matters v11 or most prior version makes this easy to do.  You can then send these records on to other programs such as Tabs3, Timeslips, Quickbooks, PCLaw or just use Billing Matters advanced billing features without the need to send because they are already there.

Also, Time Matters includes a  ’basic billing’ feature (free) a which produces an itemized bill which is all many estate practice require.  Time Matters will also allow you to send time and expense record to many other, more advanced, billing programs.

The Time Matters Solution: Create billable time entries from case management records using the following features:
1. Use the send to billing feature to eliminate typing in billing what already exists in case management

2. Use triggers for automatic time records and prevent missed time entries

3. Use the Daily Calendar to create/view and manage daily time – see if it been billed and the total for the day

4. Use Tag/Process/Send to Billing – to create an entire batch of time records

5. Use the Timesheet to view and capture time – see the billable vs non-billable totals

6. In a hurry, just start typing on the Daily calendar to pop-up the Event Quick Entry,and then when you are ready open the event and click the Send to Billing icon

7. Finally, use custom reports to view and manage time records
– quickly time summaries billable and non-billable for any selected time period Week, Month to Date, Year to Date.

So, what is new to some is old to many others, isn’t it about time to better understand your options and to take some steps to use what you may already own.  Besides all you have to lose is some time and some money.

Recently we attended the Elder Counsel meeting in Philadelphia, PA
and the LCPLFA meeting in Bethesda/Wash D.C.
It was great seeing many of our clients at these events.

SOS Small Office Server – Update Oct. 2011 – New Clients

In the last month or so, Premier has new SOS server clients in four states: Delaware, Texas, Virginia and Michigan.   This means our SOS, Small Office Server, subscribers are now located in AL, DE, FL, MI, MO, NJ, NY, OK, PA, TX, VA, WV.   Litigation, Estate Planning, Bankruptcy and other firms have discovered how this system provides a ‘cloud like’ fixed monthly server expense and remote access from anywhere while still maintaining the peace of mind of knowing your data is stored right in your own law office, with the full feature functionality of proven local area network based programs.

The latest version of SOS uses  upgraded server hardware and can support iPad or remote PC  ’terminal server’ access by any authorized user.   We also assure each firm maintains both an on-site local backup,  as well as, an on-site web based backup of its data.  The server and individual PCs may be completely imaged for fast restoration of programs and data in the event of a computer hardware failure.

Over two years ago (as the cloud formed on the horizon), we looked at the state of feature/functionality of cloud systems, and also looked at the per user cost of cloud subscriptions and decided to offer a blended solution – the best of Cloud and LAN . The server hardware/software/technical services/support is covered by a low monthly subscription fee. Remote web based access is enabled. The ‘geo-location’ is right in the subscribers office. We included a 30 day post installation guarantee, and a total term commitment of 12 months. Doesn’t this then provide the best of both: cloud benefits – someone else to finance, install, manage, universal secure remote access, etc. with the non-cloud benefits of data security, LAN performance and reliability, and full featured software? We have a large enough number and several years with these subscription based installations – the clients are happy, we are happy – what am I missing? Oh – the blended cost solution is equal to a 2-3 user cloud subscription.

Also,
How many Cloud users got rid of there local area network?
What’s the opportunity cost of using software that isn’t full featured and fully integrated.
We do use hosted Exchange and on-line backups and GMail etc., but for replacing the traditional systems with Cloud only alternatives I don’t see it – not yet.

I find most Cloud users either can’t afford the traditional investment or have had a bad experience with their local vendor and therefore are running from a bad experience versus running toward a well thought out plan that considers all their options. $.02

‘Plan A’ for many small firms is to build a single file server configured on the premise that  it will not fail.  The problem is even the best systems will fail.   ‘Plan B ’ is what you do when Plan A stops working.   Rather than one monster file server, we suggest re-thinking your single server approach by considering a two server approach.  The benefit is a ready to go backup file server, and a plan for a rapid restore so you can continue to run your critical applications.  When the time comes, the presence or absence of a good plan B will either make or wreck you day.
